Your agreement with SpeakCapsule
SpeakCapsule is operated by Nguyen Phung Hung (Hung Nguyen), Vietnam. These terms apply to speakcapsule.com and the services offered through it. Questions and complaints can be sent to temredalert3@gmail.com.
By creating an account or using the service, you agree to these terms. The Privacy Policy explains our data practices. If you do not agree, do not use the service. These terms do not remove any mandatory consumer or privacy rights you have under applicable law.
Eligibility and your account
You must be at least 13 and meet the age and consent requirements where you live. If you are not legally able to agree to these terms by yourself, a parent or guardian must authorise your use and any purchase where required. Do not create an account for a child below the applicable minimum age.
Provide accurate account information, keep your sign-in credentials private and tell us about suspected unauthorised use. You are responsible for activity you authorise through your account. Do not impersonate another person, transfer access without permission or share access in a way that circumvents plan limits.
Learning services and AI limitations
SpeakCapsule offers IELTS Speaking practice, mock exams, vocabulary tools, AI feedback and conversations, community features and virtual rewards. Some features are experimental and may change, have limits or be temporarily unavailable.
Mochi, scene partners, hints, personal notes and automated grading are AI-generated. They may misunderstand speech, produce inaccurate or unsuitable text, or make inconsistent judgments. Estimated bands are not certified scores; pronunciation feedback depends on available audio evidence. Check important information and use your own judgment.
We do not guarantee a particular band, improvement, admission or exam result. Forecast question sets are practice material and predictions, not a promise of questions you will receive. SpeakCapsule is an independent learning service and is not affiliated with or endorsed by IELTS, the British Council, IDP or Cambridge.
Fair and acceptable use
Use the service lawfully and respectfully. You must not:
- Harass, threaten, exploit or share private information about another person, or upload content you do not have permission to use.
- Try to access other accounts, extract credentials or private data, bypass payment/usage limits, disrupt infrastructure or use the app to commit fraud.
- Manipulate AI instructions, challenge evidence or reward systems to obtain unauthorised access, fraudulent completions or rewards. Honest mistakes and ordinary imperfect English are part of learning.
- Resell service access, run unauthorised bulk scraping or automated requests, or copy and redistribute protected question sets, artwork or app content without permission.
Your content and app materials
You retain your rights in the answers, recordings and other original content you provide. You give us permission to host, process, transcribe, display and otherwise use that content as needed to deliver the features you request, secure the service and handle support, as described in the Privacy Policy. This is not a transfer of ownership or blanket permission for unrelated model training.
You are responsible for having the rights and permissions needed for anything you upload or share. Only share another person’s voice, image, work or personal information if you have the necessary permission. Public or shared content is visible to the audience indicated by that feature.
SpeakCapsule branding, interface, original artwork, code and learning materials remain protected by their owners’ rights. You may use the service and its learning output for your own learning, subject to these terms and any third-party rights. AI output may not be unique or copyright-protected.
Plans, payments and cancellation
Available plans, included features, usage limits, billing period, currency and applicable price are shown before purchase. Do not rely on an older screenshot or AI answer for current pricing. Payments are processed by Stripe or payOS, depending on your selection and availability.
A recurring Stripe subscription renews according to the terms shown at checkout until cancelled. You can manage an eligible subscription in your account or contact us for help. Cancellation normally stops the next renewal while access continues until the end of the paid period. Deleting or ceasing to use the app does not by itself cancel a subscription.
payOS purchases provide prepaid access for the purchased period and do not automatically debit a renewal through our app. Any extension requires another payment. Plan changes and their timing follow the information shown when you make the change.
Contact temredalert3@gmail.com about duplicate charges, failed access, billing mistakes or refund requests. Refunds are assessed under applicable law, the purchase terms and the circumstances; nothing here excludes a statutory refund or cancellation right. We will give appropriate notice of material pricing changes before they apply to a future renewal.
Capsules, coins and digital collectibles
Coins, stamps, companions, decorations, skins and other collectibles are virtual features for use within SpeakCapsule. They have no cash value, are not an investment or currency, and cannot be redeemed for money through the service. Randomised rewards do not guarantee a particular item.
Virtual features are subject to the rules and availability described in the app. We may correct errors, remove fraudulently obtained rewards or adjust systems for fairness. Event availability and reward pools can change. Any change affecting paid rights remains subject to applicable consumer protections.
Availability, suspension and ending use
We work to keep the service useful and reliable, but do not promise uninterrupted operation or error-free AI. Maintenance, model capacity, network conditions and third-party services can affect availability. Keep your own copy of anything important.
We may restrict or suspend access when reasonably necessary to address serious abuse, fraud, security risks, unpaid charges or legal obligations. We will provide an explanation and a way to contact us where appropriate and legally permitted. You can stop using the service and contact us to request account deletion.
If we discontinue a paid service or materially reduce paid access, we will give appropriate notice and address any required remedy under applicable law. Account deletion and payment cancellation should each be requested or completed as needed.
Responsibility and your legal rights
To the extent permitted by applicable law, the service is provided as available without a promise that it will meet every learning goal. We are not responsible for an official exam decision or for a decision you make solely in reliance on unverified AI output.
Nothing in these terms excludes liability or remedies that cannot lawfully be excluded, including mandatory consumer protections or liability for fraud and other matters protected by law. We do not require you to waive those rights.
The operator is in Vietnam. Applicable law, including any mandatory protections in the place where you live, determines your rights and the competent authority or court. Contact us first if a problem arises so we can try to resolve it; this does not limit your right to seek a legal remedy or complain to a regulator.
Changes to these terms
We may update these terms as the service changes. We will show the revision date and give an appropriate notice for material changes. If a change requires fresh consent under applicable law, we will request it. If you do not accept updated terms, stop using the service and cancel future renewals as needed; rights that already accrued are not removed retroactively.
